Plan Ahead When Making a Gift to Your Special Needs Family Members

If you have a family member with special needs, you already know how vitally important monthly payments from the Social Security SSI program and medical coverage through Medicaid can be to their well being. Yet, there are so many other services they could benefit from that are not provided by these programs. In order to help them obtain these additional services; you, your other family members and even friends may decide to make a gift to the special needs person either while you are alive or when you die through your will. If you are not careful in the way you make that gift, your well meaning gift may have the catastrophic result of causing the special needs person to lose the SSI and/or Medicaid benefits they depend on.

SSI and Medicaid benefits are available only if the recipient has income and assets below a certain level. If your gift to the special needs person is not made through a special needs trust acceptable under the SSI and Medicaid guidelines; that gift will most likely push them over the income and asset limits and jeopardize their continued ability to receive those benefits. So, before you make a gift to a special needs person, plan ahead and make sure that the gift is delivered through a special needs trust so that your thoughtfulness really will be an enhancement to the special needs person’s life.
